B2SHARE Premium Terms of Use
Introduction
This document describes the EUDAT B2SHARE Premium service's terms of use and responsibilities of service users and contractual parties. This document is part of EUDAT B2SHARE Premium Service Description.
Responsibilities and Rights of the Service Users
- Service Users must adhere to EUDAT CDI Acceptable Use Policy and Conditions of Use (AUP).
- Service User must adhere to EUDAT Services Terms of Use.
- Service Users must agree and comply with the responsibilities described in the General Terms of Use for CSC's Services for Research.
- User is responsible for ensuring that the content processed in the Service are used with rights that entitle the User to process the content in question in the manner intended in the Service.
- AUP: You shall respect intellectual property and confidentiality agreements.
- User is responsible for ensuring that the necessary descriptive information is attached to the data stored in the Service. The required descriptive information is specified as mandatory information in the Datacite DOI metadata model.
- The processing of personal data is subject to the terms and conditions for the processing of personal data as described in the EUDAT B2SHARE Premium service privacy notice.
- In case of problems and to ensure the protection of their rights, users can request assistance from the service support address provided by the Customer organisation.
- Users should report issues caused by the user or about issues with a service, service component or resource provided by EUDAT partners in a reasonable timeframe, if the issue is related to a violation of these terms.
- Reports about violations should be directed to the service support address provided by the Customer organisation, which will document and handle the issue.
- You shall promptly report known or suspected security breaches, credential compromise, or misuse to the security contact stated below; and report any compromised credentials to the relevant issuing authorities.
- Users authorize the Service Provider to copy the descriptive information of the datasets selected for open publication in the Service to EUDAT B2FIND and other national and international research data repositories (such as Fairdata Etsin service). Copied metadata can be further harvested to other similar research information services.
Responsibilities and Rights of Customer and User Communities
- Customer names at least one, usually more, main responsible persons to the Service provider.
- For Premium services, Customer defines which groups of users can have access to and publish data in the service.
- Customer will instruct the Users of the Service acting on their behalf to comply with the terms and instructions provided by Service Provider. The instructions will pay particular attention to the issues related to information security.
- Customer is responsible for ensuring that the content processed in the Service is used with rights that entitle the Customer to process the content in question in the manner intended in the Service.
- Customer is responsible for ensuring that the necessary descriptive information is attached to the data stored in the Service. The required descriptive information is specified as mandatory information in the Datacite DOI metadata model.
- Customer acts as the controller for the data stored in the Service. The processing of personal data is subject to the terms and conditions for the processing of personal data set out in Service Contract. Customer is responsible for ensuring that the subject matter, nature, and purpose of the processing of personal data, as well as the types of personal data and categories of data subjects, are described in the document "Description of Processing Activities" before the Customer begins to transfer personal data to the services. Customer is also responsible for keeping the Description of Processing Activities document up to date and commits to updating the description to correspond to the content of the personal data transferred to the Services at any given time.
- The processing of personal data is subject to the terms and conditions for the processing of personal data as described in the CSC EUDAT service privacy notices.
- Customer ensures that Service Provider is aware of Customer's needs relating to system maintenance and service development.
- Customer provides the Service Provider with the service address of it's organisation, to which persons belonging to the organisation can report any errors they encounter. Service Provider is responsible for ensuring that this service address is visible to end users of the Service as part of the user interface.

The customer will investigate errors in the service as follows:

Check and confirm errors

Resolve administrative issues related to the Service and systems

Provide user support to persons belonging to the organisation or otherwise providing access for using the Service

Report unresolved issues to the Service Provider's support address

Assist the Service Provider by providing additional information for the purpose of analyzing and testing error situations.

- Customer is responsible for ensuring that the information provided to the Service Provider is as accurate and precise as possible, and commits to notifying the Service Provider of any changes in the information, where possible. Customer is responsible for notifying the Service Provider, where possible, if any information provided changes during the term of the Service contract.
- Customer authorizes the Service Provider to copy the descriptive information of the datasets the Customer has selected for open publication in the Service to EUDAT B2FIND and other national and international research data repositories (such as Fairdata Etsin service). Copied metadata can be further harvested to other similar research information services.
- Each B2SHARE user Community has additional responsibilities as detailed in the B2SHARE Community Agreement. Community Administrators agree to these terms upon creation of the community and assignment of the community Administrator role.
Responsibilities and Rights of the Service Provider
- Service Provider may at any time limit, suspend or terminate access to the Service, including removal of User Content within the service without notice
- In the event of any unauthorised use of the Service
- If the Service Provider has a justified reason to suspect the Service is used contrary to these Terms or Service Descriptions.
- Service Provider reserves the right to inspect User Account information and User Content for purposes of incident management, error correction and in case of suspicion of illegal or otherwise inappropriate use of the Service.
- Service Provider has the right to contact User's home organisation or Community Administrator, or other party granting access to the Service, regarding actions needed for correcting illegal, outdated or otherwise inappropriate data or metadata.
- In Premium services, the Service provider will notify the Customer of any need to change the Service in good time in advance, and the effects of the changes will be discussed with the Customer before they are made.
- Service Provider maintains up-to-date documentation.
- B2SHARE's up-to-date service documentation is available at https://docs.eudat.eu/b2share/overview/
- Additional service-specific technical documentation for Premium services will be provided to the Customer and maintained by the Service Provider.
- Service Provider can make updates and clarifications to service documentation or other instructions on their web pages.
- Service Provider notifies of significant changes on the service website.
- Service Provider does not guarantee the accuracy of the documentation, and the Customer uses it at their own risk.
- Service documentation will be provided in English.
- The use of the B2ACCESS component can be necessary for the functioning of the Service. Service Provider is not responsible for providing this component. Documentation of B2ACCESS can be found at: https://docs.eudat.eu
- Any errors related to the operation of the B2ACCESS component shall be reported to the Service Provider
Changes to these Terms
Service Provider reserves the right to change these Terms by notifying the User. If the User continues to use the Service after the stated effective date of the amended Terms, the User is deemed to have accepted the amendment.
